David Heß, a car dealer from Murr in the Ludwigsburg district, is facing enormous challenges due to an alleged fraud involving 40 Nissan Leafs without vehicle documents. In one fell swoop, he says he lost around 500,000 euros after purchasing the vehicles a year ago from the now defunct company Vivelacar. This is reported by the Marbacher Zeitung.

After an initial successful transaction in which the first five vehicles were sold and the relevant documents were delivered, it turned out that the other vehicle registration documents were missing. This caused planned sales to several countries, including Iceland, Norway, Denmark, Finland and Ukraine, to fail. Hess could not ignore the increasing complaints from buyers and had to cancel all resales.

Consequences for the car dealer

The unsold vehicles not only block Heß's company premises, but also endanger the liquidity of his business operations. He discovered that he had paid Vivelacar but was stuck with the transport costs. There is no immediate fear of insolvency as his car dealership has done well, but the financial situation is tense.

Heß has already taken legal action against the former managing directors of Vivelacar. It is precisely in this context that the successor company x-Mobility is uncooperative and denies any liability for the events. According to Heß, it could be that the vehicle documents are with the bank that financed the vehicles. Unfortunately, the bank refuses to provide any information due to data protection regulations.

Criticism of Vivelacar and x-Mobility

In addition to Hess's problems, there are a number of reports about Vivelacar that point to potential fraudulent practices. Some users have reported that their car subscriptions were canceled without notice and without providing any reason. A pickup date for the vehicle was not announced until a few days after the termination, and customers received information that the car could be kept if a new contract was concluded with x-Mobility GmbH, which was also criticized.
This information comes from Trustpilot, where many users warn about the websites of the two companies.

The company name provided by X-Mobility also raises questions as it is not recorded in the company register. It is also reported that both Vivelacar and X-Mobility use the same VAT ID, which is not permitted in Germany. Such practices give buyers the suspicion that fraud may be taking place.

A former managing director of Vivelacar has announced that he will clarify the outstanding questions regarding the vehicle documents with the bank and Heß and that he is prepared to take back the 40 vehicles. Whether this step can represent a solution for Hess and his problems remains to be seen.
